A patent search is performed for the purpose of finding the most relevant existing US Patents to your invention (referred to as "prior art") and is typically conducted in the early stages of the application process by an independent patent search firm. A positive result of a patent search does not predict with certainty whether an invention is or is not patentable but is used as a guide to whether further action is likely to be worthwhile. The search is primarily focused on determining whether a similar invention already exists and if someone else has filed a patent application with the United States Patent and Trademark Office (USPTO). Is a patent search important? Yes. A patent search of all existing US Patents can provide excellent information to base a decision on whether or not to move forward with an idea, although it cannot guarantee that an idea will ever become patented. In addition, it is better to find out up front that patent protection is not available for an idea, rather than waiting until you have invested time and money pursuing the idea.
